Movement at The Station

After there was considerable talk on the residents FB page regarding moving of the Blue Office, Burt sent a request for more information from the Developer on 25 July 2025. Their reply dated the same day did not give any details. Then on 31 July, out of the blue, came another email stating a DA was being worked on and they would let us know more once it had been lodged. This was followed on 1 August by another email containing an attachment from the Developer himself addressed to Community.

Unfortunately, over the past years we have been speaking with the Developer, he has always used the same time frame to support his unsustained promises, of "2 weeks".


We Want More Details

We have therefore answered asking for more detail. Although he has shown us numerous plans for the proposed shop, the last one was presented at a meeting between the Alliance, PA members and the BAG, which looked very good, he has not provided us with any further details at this stage. At the meeting referred to one person from the PA was relentless in his negative and hostile comments regarding the shop that the Developer stated if this all got too hard he would walk away from it.

It is also interesting to note that this letter comes after talk, again on the residents FB page, that people were unhappy with the unfulfilled promises made to them when they purchased land at Beaches, talk of taking legal action and so on.


The Window Has Not Closed

It had been mentioned on FB that our window of opportunity had closed in order to force the Developer to make good on his promises, which can also be called misleading and false advertising, but this is not so. The window is still open while land is still being sold in the Oceanside Estate. But time is fleeting.

We would encourage everyone to stay on track and not be distracted by this latest claim that in a couple of weeks a DA will be forthcoming and everything will be fine.

As we all know even if a DA is submitted and approved by council, it does not mean that a shop will be built in a reasonable time frame.

Dear Bryan,

It has been some time since you presented your plans for the shop/cafe at Beaches. Since then, the park has been completed, the Oceanside development finalized—yet the promised retail facility remains unrealized.

During early meetings, you assured us that the shop would be constructed concurrently with Oceanside. This assurance was more than casual—it was central to the appeal and perceived value of the development. Both original Beaches residents and those who joined later through Oceanside were consistently informed, during the sales process, that the shop/cafe would be built.

To date, we have viewed three iterations of the proposed design. The most recent was met with overwhelming support from community members present at your meeting. Moreover, in your conversation with The Beaches Action Group, you confirmed unequivocally that you intended to build it, expressing enthusiasm for a design inspired by a small American deli.

This leads me to ask once more: Will you honor your commitment and proceed with construction of the shop/cafe?

Given that many residents made purchasing decisions based on representations made during the sales process, continued delay or abandonment may raise serious concerns—including potential legal implications. If the shop/cafe is not built, it may constitute a breach of implied contractual understandings or misleading conduct under consumer law.

We remain hopeful that you will fulfill the promise made to this community. Your response will determine whether further action is warranted.

The Beaches action Group Response to the above letter.

Dear Rachael,

With all due respect we have been told the same thing on numerous occasions over the seven years we have lived here in Beaches Estate. My concern is that this is just another delaying tactic, hence my letter.

If you want us to have more faith in your correspondence, then I would suggest you give a more detailed explanation and proper time frame with a positive agreement that the DA will actually be submitted to council within the two-three week time frame and the shops will be built and completed soon after.

The Beaches Action Group Have Been Working Quietly in the Background

The BAG has continued in our persistence to bring the Shop/Cafe to fruition, we have had success in obtaining the park however, we now need help from the community, if the developer decides not to go ahead this time, we may have to take this to the media and/or seek legal advice for a Class Action Suit.
